Maharashtra Budget Session: A Historic Absence of the Leader of Opposition
The upcoming Budget Session of the Maharashtra legislature, starting this Monday, will mark a first in the state’s history. For the first time, both the Legislative Assembly and the Legislative Council will conduct proceedings without an official Leader of Opposition (LoP).
The opposition Maha Vikas Aghadi (MVA) has called this development a “threat to democratic norms.” They argue that the absence of an LoP weakens the system of checks and balances, especially since the ruling BJP led Mahayuti alliance holds a strong majority.
Opposition Claims a “Blot on Democracy”
Shiv Sena (UBT) MP Sanjay Raut spoke out on Sunday, describing the lack of an LoP as a “blot on democracy.” He stated that the constitutional role of the opposition which is to hold the government accountable is being intentionally undermined.
The vacancy has existed since the 2024 Assembly elections. Currently, no single opposition party has reached the traditional 10% strength required to officially claim the LoP position.
Questions Over Rules and Appointments
Shiv Sena (UBT) MLA Bhaskar Jadhav accused the ruling coalition of being arrogant. He claimed they are deliberately weakening democratic processes by not making it easier to appoint an LoP in both houses.
Jadhav mentioned that he contacted the Maharashtra Vidhan Bhavan administration to ask about the specific rules for appointing an LoP. However, he was told there is no specific law or statutory provision governing the role. He pointed out that in the past, parties with fewer MLAs were granted the LoP post. Even though Shiv Sena (UBT) has 20 MLAs in the 288 member assembly, they have been denied the position.
When asked for a response, Chief Minister Devendra Fadnavis told reporters, “This decision is the prerogative of the Speaker of the Assembly and the Chairman of the Council. I cannot comment on it.”
Complications in the Legislative Council
The situation in the 78 member Legislative Council became more complex following the resignation of Congress MLC Pradnya Satav in December last year. Her exit ended the party’s hopes of claiming the LoP post in the Upper House.
Pradnya Satav, the widow of late Congress MP Rajeev Satav, resigned on December 18 and officially joined the BJP. This move came shortly after the Mahayuti alliance’s major victory in the 2024 elections.
The Impact of Defections
Before she left, the Congress had eight members in the Council, which met the 10% threshold needed to claim the LoP post. The party had already nominated senior leader Satej Patil for the role. However, Satav’s resignation reduced the party’s count to seven, making their claim invalid.
Former Congress state president Nana Patole alleged that the ruling alliance is using promises and rewards to trigger defections. He called Satav’s move part of a broader “Operation Lotus” strategy to destabilize the opposition.
In response, Satav who was reelected to the council in July 2024 for a term ending in 2030 stated she joined the BJP because she supports the development agenda of the Mahayuti government.
